    my wife is on her OPT and I am on my F1, her employer just filed for her H1b and my H4 I539 same time this week. (non profit university). So my question is do i need to go back to school next month to continue my education? or as long as the I539 is filed, i am under legal status? right now I have moved from Nebraska where we had our education to New york with my wife. if I have to go to school even when the I 539 is pending, can i just go transfer my status from the community college I am studying at in Nebraska to any community college that offers I-20 in New york? how can i report the change of school to USCIS after transfering? thanks!

    Ooops... I posted my reply to the pic in the gallery! To reiterate here, I love this photo... the only distracting aspect is the deteriorating wall in the shadows on the left. I played with some creative cloning and removed it and quite liked the results. Other than that, the color, symetry and lighting all come together in a really compelling way. It's one of my personal favorites!

    Hi,
    I got H1 in 2008.
    I want to that till how much time is the petition valid , if I dont go for stamping.

    Also , suppose my company withdraws the petition, so now till how much duration my cap number is valid?

    Expiration date will be mentioned on I-797 approval notice
    you will be counted only once against cap. and you can be on H1/L1 for total of 6 years (without a break) - ofcourse assumption is that you never file for a GC

    I had the sample problem. There was an extra letter in the last name. I waited till the labor was approved and then notified USCIS while filing I-140. There was no issue. You do not have to worry about it

    After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

    Mat - thanks - went to Adobe's web site and found out that CS3 does not support the RAW (NEF) files from the D300s. Would have to upgrade to CS4 to be able to load the D300s RAWs. Makes me wonder about Adobe - makes me glad I didn't plunk down big $$$ for CS3 - Elements works just fine for me!

    I was just checking my H1b extension status and it seems that it got approved (3 weeks time). while looking for my H1b extension status i happen to find the link below,

    USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/)

    It gives the processing trends by month based on trends or volume of application processed. This dashboard is for all applications forms submitted to USCIS, you can select form type, office and chart type. Data can also be downloaded in CSV raw format for analysis.

    The AC21 determination of whether a new job is in "the same or similar occupation" is made based on a comparison of the new job duties and those set forth on the original labor certification application. Job titles are not controlling. So, you need to have a copy of your original LC application and then compare the job description it contains to the duties of the new position.

    Many of us have had a positive reaction to the TB skin test. So we take an X-ray to confirm we are fine and the doctor mark normal in the chest X-ray section. Pretty routinely done.

    Now my spouse had a negative TB skin test, so no X-ray needed. However the physician and my attorney have different views on how to fill out the chest X-ray section of the form. The physician checked nothing in the section and is very adamant about the way he fills out the form. My attorney believes that the NOT DONE box in the section should be checked as he claims that he has seen REFs if the NOT DONE box is not checked. What is your opinion? Appreciate your feedback.     There has been an error in the processing of my I-130 petition for my mother. It was approved and now I am being asked to submit form I-485 or form I-824. The problem is that my mother is not and has never been to the US. I called CIS and talked to a representative about the error. She said she would send a letter to the CIS about it and that I should hear back from CIS in 5 days. I am just wondering if this timeline is realistic or I should expect it to take more time. Should I contact my senator and ask for assistance in facilitating this process? Would hiring a lawyer expedite this process? I know that the petition should then go to the NVC. Would a lawyer help?

    I think immigration firms will stay out of it for the sake of the law suit. However companies like MS, oracle, and hospitals maybe should join.
