I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?

Good Morning,
I would like to ask some questions about changing jobs. I am currently on a second H1-B, and have applied for a green card (Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS). The company�s attorney sent me the following form as a receipt: I797C application to adjust to permanent resident status.
If I decide to join a new company, what do they have to do? Can I change jobs keeping my current H1-B? Do they apply for another H1-B and then restart the green card process? What documents are required to port my current priority date?

90 days window period for H1 Stamping before the validity starts.
10 days window period to enter US (Use when it is absolutely necessary, if not, safe enter on the date it starts are after that)

It's been several years since the employment-based preference categories developed huge backlogs. However, no one was prepared for today's announcement from the State Department that most of the family-based categories will retrogress between one and three years beginning on January 1, 2011. Consider the worldwide categories: Beginning in January 1, the 1st preference category (unmarried sons and daughters of U.S. citizens) goes from a 5-year to a 6-year wait. The story is much, much worse in the 2A category (spouses and children of permanent residents) where the wait expands from a mere 4 months to 3 years, a 9-fold increase....

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

Only during I 140 USCIS will ask for Exp letter whatever you showed in PERM. I think your previous exp should be related to your new job role.

In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and did not bother to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.
Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.
If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

Did any body renew thier EAD's recently?..instruction on page 12 says that the Filing fee of $340 is waived coe category C9...is that true..:confused:
