    On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.     I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.

    Now I am going to e-file EAD renew.There are some questions in the form I-765 that I am not sure how to answer (The lawyer has completed his 140 and 485 document, so he doesn't want to answer now.):

    1, Manner of Last Entry into the U.S.: Should I choose PAR (PAROLEE) or H1B (SPECIALITY OCCUPATION)?

    2, Status: Should I choose PAR (PAROLEE) or H1B(SPECIALITY OCCUPATION)?


    3, Please select your eligibility status : Should I choose (a) (4) PAROLEE or (c) (9) FILED I-485?

    How can I transfer a raw file into a jpg file in Photoshop? It only give me a few options-tiff., phtshp, ect... I want to upload a few pics and can't figure it out.

    You should be fine. If you I-140 is not approved by 2008, you can apply for a 1 year extension based on the fact you have an approved labor. Otherwise you would get a 3 year extension.

    I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.

    Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?

    Please advise.

    Filed July 1st 2007 and my I-485 was transferred from NSC->CSC->NSC. Have a I-485 receipt # that starts with WAC, but is currently pending at NSC. Any recent WAC# approvals?

    Tried opening a SR - the SR# ends with CSC. I don't think it will help as SR was directed to wrong Service Center.

    In addition to all USCIS inefficiencies, this transfer between service centers makes my case all the more confusing and even more unlikely to be approved anytime soon. Very frustrating!!

    I filed my case in July 2nd(filer) and didn't receive my receipt and then again I file the same application/case on Oct 2007. Finally I got both the receipts.

    I'm going to India and is planning to get my h1 visa stamped...

    How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...

    I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..

    Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...

    Can someone pls advise me on this?

    I remember some time back having seen a link where you could get the list of labors/I-140 for a particular employer. I am not sure if it is in http://www.flcdatacenter.com/ . Can some one point to the correct link where you could get the list of H1 or Labor or I-140s approved for an employer based on the company name?

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    Hi All,
    One of my friend has been working for a desi company for 6 months and now is moving to another company.

    In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
    There is no statement regarding leave encashment policy in the offer letter

    So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment

    Hi all!

    I'm currently working on a personal project of mine (word processor) and there are a few things i cannot seem to get my head around and i think that they are very simple to do too...Maybe... First, I'm trying to open a new instance of my program by simply clicking a menu option on my form. i'm using visual c# 08 express edition, windows forms application... I have attached an image (very small image) to show u what i mean.. i'd appreciate anyone's help/advice on this, thanks for reading :-)

    In case, if we dont have a birth certificate, I understand we need to submit 2 affidavits and NA certificate from the place where we were born.

    My question is, do we need them in original or copies will work?

    If we need originals, getting them from India takes time...

    Guys, applied recently for EAD and its pending and 180 days has not passed. I am planning to open a part time business. Does anyone know if its ok to start a part time business before the EAD gets approved ? Any insights will be appreciated.

    If you draw salary as an employee of the business, it is a problem. Consult an immigration attorney. You cannot take up any work other than what is approved as part of your H1-B.
