Hi Folks,
My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?
In the other word:
Once you have child born in USA is there any way to get green card based on your child citizenship?
Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.
Otherwise, no.

Hello friends
I am thinking of taking these semester off because of my health issue
I had decided to attend classes and booked my ticket in April to my country. I am an international student
So I was thinking how many months I can stay in USA after I take a semester break
Also if I take these spring break off and than the summer break is off by default so will it be a problem if I am not in status for 7 months?
Please let me know

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping with an L1 visa already in his passport, will it affect the visa officer's decision in issuing a H1 visa?
Please chime in if anyone has done this before or has any insight on this matter.

I just got an RFE on my 485 as following.
Submit a letter of employment attesting to your current employment. This letter should be written on the company's official letterhead and cite the date you started working, whether the position is permanent and full-time, a description of the position, a description of the position that you currently hold for the company (if any), and the offered salary.
When I invoked my AC21, my new lawyer submitted G-28 but with out any details about my new employment. I hoping that this RFE is related to that. My only concern is that my old job title is programmer analyst and my new job title is Business Solutions Architect with similar (probably a little more) job duties.
Please share your experiences if any one has received similar RFEs.

Hi All ,
First of all , thanks soooo much for this great site. I have a small question. My PD is July 2002 under EB2 / India. I was stuck with name check. Now that name check does not matter because of new rule > 180 days and my PD becomes current from today - April 1 , how long does USCIS take to make a decision about my case ? Do I need to call them and request a case review or do something to see some movement ? Kindly advice. Or is it just wait ?

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

Could someone please detail the process of adding your wife to the existing 485 application. I am sure there are many folks like myself who had applied for 485 before they got married and now have to add their spouses whenever the dates become current
