Hello,
I would like to prepare for the worst scenario that might happen in near future since I only got about two months of H1B
I didn't even know what " RFE" was until I recently received it. From my first H1B app to LC, things have gone so smoothly.. but now I am starting to realize that this could be jeopardize my whole career in U.S if I don't get approved from I140.
When I started my PERM processing last year,my lawyer made sound so easy about getting a GC that the paralegal who handles my case has never told me anything about" if things goes wrong",which I am afraid that it might be happen soon...
If I get denied from I140, Is there a way to extend my H1B ? or any other way to keep my job in U.S legally ? Could anyone give me some advice ?

I have filed for the 7nth year extension based on my pending labor (365 days old). The perm is picked up for an audit. Incase if the perm is denied, will h1b also be rejected ?

I was searching on all programmer salary's on SalaryList.com (http://salarylist.com), it looks like we are much higher than the other majors, business analyst, finance analyst. So if I want to do AC21, in current condition, should I keep same salary? Several companies I talk to can only match now

Reform Immigration For America reports that 500,000 people participated in May Day protests at 80 events around the country. I was attending my 20th law school reunion this weekend in Chicago so took the opportunity to attend the event in the Windy City. The crowd was enthusiastic with lots of signs criticizing SB1070 and calling for immigration reform. And lots of US flags .

I am trying set up an appointment for the last week of April (Apr 27-May 1) in Matamoros, Mexico and came across the following website about their wait times:

1) Does it mean that I can setup my H1-B Visa Appointment only before 15 days of Apr 27th?
2) What does Typical Wait Time (Workdays**) for a Nonimmigrant Visa To Be Processed****: 28 Days mean? Does it mean that it will typically take 28 days to get Visa stamping after your interview?

I saw that my 485 status was updated twice.
FP done on - Oct 24, 485 LUD was 24 Oct.
Nov 3 - one more LUD on 485 app for me and spouse.
: BEC LC cleared on June 21, PD march 2001, I 140 + 485 filed on July 2 for me and spouse.
What do you make out of the two LUDs in less than 2 weeks ?.
My I 140 is still pending. (EB2 Category)

No, the H1 6 yrs period will apply only when for the period when your Payrolls where generated using H1 visa.

We also need to raise our voice for the Out of Status stuff.
Most of the consultants have one or more pay stub missing etc. There needs to be a amendment that more than 6 months so called out of status can also adjust their status by paying some fine or something because
1. Most of the employee are ignorant about this
2. and most employers take advantage of the situation and they are the ones who should be accountable and not the employees.

The immigration law firm of Fong & Chun, long-time advocates for gay and lesbian immigrants, receive questions regularly about how gender is reflected on official documents.
Effective today, a US citizen applying for a US passport may present a letter from a physician that the applicant has had "appropriate clinical treatment for gender transition," and the new passport will be issued reflecting that new gender. A short-term passport can also be issued be those who are still transitioning.

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. Aside from being contrary to established procedures for revoking visas, CBP officers made inappropriate comments and issued threats that cry out for some form of disciplinary action by DHS: It is then no surprise that the outrageous singling out of Indians since the New Year waiting in the line at Newark and other airports by CBP...

Last time we took our photos at Ritz Camera...they accepted mine but held her case due to these photo issue...
My attorney received this RFE and he scanned it for me..
Do we have to submit the entire app now?
