1) Can I file EAD/AP now; I applied 485 on July 3 (no receipt number yet, but application received by USCIS)?
2) What all docs are required for filing EAD & AP? I want to file it myself.

MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.
What are the limitations in this path. Do we always have to be in USA on valid H1B.

My wife works for a University on her CPT. The University received a prevailing wage for her for her H-1B from the state agency on December 31, 2009 and it is still valid.
1. So when the University files for the LCA, can they use the prevailing wage from the state agency or do they have to use I-CERT for prevailing wage (ETA Form 9141)? Can the University use any other source for prevailing wage?
2. How long it is taking now to get the LCA certified?

Hi,
Can the invitation letter and the letter to the consulate be faxed to my parents to present to the consulate, or do I need to courier the original signed letters over?

Hello Folks:
Sorry for this new thread. But I need help in interpreting the information that I got when I went to Local Office.
My I485 is in Locak Office and it was transferred to the San Jose office after we had our interview in Boston back in October 2005.
When I spoke with the officer (not IO) he said that quote:
" Priority Date
AUA 1 or / 7/1/07
I 485 Forward to 245 Unit "
What does this mean? Can you guys help me understand what he is trying to say. I mentioned that we are already interviewed.

1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

You will be out-ofstatus. And you need to find a job before 30-day grace period (it depends on the person who is handling your case) and move back to H1. Otherwise you cab either change to a different visa category if possible else you have to find a job and get your H1 through consular processing which happens to visit your home country get the visa stamped and comeback to US.
I am not sure about your previous H1B. if they have revoke your h1 then you cant do anything.
This is my opinion. But you can wait what others to say about this.

On I-765 item# 11 it asks us "Date". Which date are they referring to? Cause I had applied for OPT EAD twice (duration of 6 months each). Can someone pls let me know.....

We filed for our 2nd AP on July 2nd. They received it on 8th and mine was approved on 22nd. Got my AP yesterday. No idea what happened to my spouse's. I got that RN from the back of the check and called USCIS. I entered the 10 digit RN and it said not enough numbers entered?? So i called again and said no RN and i got a cust service rep. I gave her the RN and she said they received it on 8th and is still processing it. She said it doesn't matter whether we filed together and asked us to wait 6 months.
Is this normal? I just hope the other AP is not lost.
Also since there is no expiry date on the AP, is it to be taken as its valid only for 1 year from the date of issue? We never had to use our 1st AP.

NSC must have used up all the FY2007 visas...if not and they did not work on the last day of FY2007, then we can conclude that they really don't care if visas are wasted or not.
Do not expect any approval from NSC today....we can only expect automatic uptdates!
