My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).
Please help me with info on these questions?
1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

If one gets stuck with H1b revalidation, and then gets approved after 6 months. Is there any issues when coming back to the US at the POE entry?

No issues, but make sure you have a updated employment verification letter from your employer saying that you still have a job. I have seen some cases with my friends where the immigration officer asked for a letter when they were outside the country for more than 3 months....One of my friends did not have a letter and the officer called his employer and verified that he still has a job before letting him in....So I would just carry a letter to be on the safe side rather than going through the hassle.....

Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.
But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

Hello Gurus,
Can we apply for H1 if our I-485 is pending while the current status is L1.
The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:
Will there be any impact or no impact at all?:mad:
Is there an option to apply without asking for COS when applying H1 with the current status as L1.:confused:

I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

hello! i overstayed my visa by several years, left , and was able to get a new tourist visa and enter the u.s.
after leaving the u.s, on return,i was denied enterance, removed and banned for 5 years. my boyfriend lives in u.s, he's a citizen. is a fiance visa helpful to allow me in until we get married? is there even a chance? or do we need to marry outside of the u.s in this case? thank you!

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?
Thanks in advance for your advice!
