Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT

Hi
My Wife was working as sole proprietor and she is planning to open Single Person LLC.
She is also planning to start her second business.
1) Can she do multiple businesses in ONE LLC?
2) Will she file multiple Schedule C for EACH business ( If you have one person LLC you can file taxes in Schedule C) ?
3) Does she has to apply for new Federal ID or she can use same she was using in Schedule C for this new LLC also?

Really disappointing. Senator Schumer says on the one hand that the targeted companies are not violating the law and on the other says they are underpaying their workers - which would be a violation of the law. Which is it? And he disparages the entire staffing industry - an industry that in the US employs far more American citizens than immigrants - by questioning the legitimacy of the business model and complaining that these companies don't make anything. Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .

Hello All,
I just wanted to ask for your general advice. My H1B expires in July 2010 so I know I have to turn in my PERM application before then so I really have only about 2 months to start recruitment process. I also have a green card to Canada so I could go there but I do like my current job in the US and living in New York City is really great!
Anyway, my question is. How tough do you think it will be to start PERM process now in this current economic downturn and the fact that it is in New York (millions of people)? Do you also think there might be some legislation in a near future to make it more difficult for us to get green cards?
I understand you can't answer those questions exactly, but a piece of advice would be greatly appreciated. Thank you all!

Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics
The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded

So we got an RFE. Bummer. Some of the things were really simple things, like I missed signing in one spot... oops. Had to get a copy of my dad's birth certificate because he's supporting my husband with his income. But two of the RFEs were for taxes which I am 99% sure that I sent in for 2007 for both my father and I, so I don't know why we got an RFE for that (I just ordered the tax transcripts for all 3 years for the both of us, just to make it easier). Anyway, they also want my dad's paystubs for the last 6 months. Cool. So I went through my dads paystubs, and two of the paystubs are missing from the last 6 months - one from May and one from March

My I140 was filed 10/01/2007 and it got approved Jun 4th,2008 I think the processing dates are little misleading.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

Can I change to different employer while the i140 is pending and also keep the PD. What i would like to do is..i want to change to a different employer and ask the present employer to keep the i-140 process as it is.
Is it ok if the i-140 gets approved while i no longer work for that company. I understand if i get any RFE, then employer need to respond accordingly.

Immigration Lawyers Blog Has Just Posted the Following:
On Aug. 13, 2010, President Obama signed into law Public Law 111-230, which requires the submission of an additional $2000 for certain H-1B petitions and $2250 for certain L-1 petitions. Those who are subject to the additional fees include petitioners who employ 50 or more U.S. employees and more than 50 percent of its U.S. employees are in H-1B or L status (including L-1A, L-1B and L-2). For example, ABC company has 60 employees and has 35 employees in H-1B and L-1 status. ABC Company would be required to pay the additional fee for all new H-1B and L-1 petition filings. Extension of status petitions are not subject to the additional fee. The new fees are effective immediately, applying to all petitions submitted on or after Aug. 14, 2010 through Sept. 20, 2014.
