    Guys don�t presume you don�t have rights for this and that. late in spring of 2005 I had a meeting with my state�s senator and he took all my details and wrote to Backlog Center in Philadelphia. After 2 months his office called me and send me the correspondence they got from BEC. They had description about my file etc. my labor was cleared in a month after that. Apparently BECs informed his office about the approval too, and to my surprize they called me up again and told me the news. They are public office they are answerable to us, we need to ask�Mirage,

    I think what Dard-E-Disco is pointing out is that, we are foreigners (Not citizens of the USA), therefore our rights are not the same as a US citizen.

    We could create rallies, voice our concerns on this forum, write letters to congressmen and senators, etc etc etc, and that is fine, but we don't have any right to really ask particularly USCIS about their internal workings. I would assume that even US citizens are able to do what you are saying. There are certain levels of confidentiality specially in government that they will never share with anyone.

    I think the same is true in your country.

    How do think would your people or governmnet react if a foreigner in your country start to question your immigation policy.

    Think about that.

    1) It's annoying to see grown up ppl fight like children.

    Since your PD is June 2003, you could have applied in June 2007 because in June Visa bulletin(released in May ) it moved till April 2004.

    This is too good to be true.. How could you apply in June if you are Eb3 with PD Sept 2003? The PD was'nt current in June. Also, how did your 140 get approved in less than a month? Premium Processing was'nt there in July...

    I have a PD of Sep 2003. I filed my labor in Nebraska in Sep 2003 and state labor got cleared in a week and federal took 2 weeks. I had my Labour on Oct 2nd. I filed for my 140 and recd approval in 3 months. I had to wait for my 485 filing as I wanted to file it with my spouse who was out of country at that time. Rest of the details are in my signature.

    BTW, those who are stuck in BEC's my sympathies are with you, its just pure bad luck your cases got stuck in there. PERM or no PERM this whole GC thing is just matter of timing.

    As for the original post I dont understand the reason for the ah's and ooh's here. The original poster please correct the mistake here, gcpadmavyuh is right, you could not have applied for 485 in June if you had PD of sep 2003. You could have applied for your 485 as early as March 2005 when the PD dates retrogressed.

    please clarify.

    I think the at the heart of this kind of reckless, selfish 'crusade' is a problem with poor upbringing.     Take a look at illegal immigrants. They break the law. Yet, they are able to unite so effectively to make themselves heard. For a group that has absolutely no locus standi for legal or political relief, they are amazingly effective in shaping the dialog around their interests.

    As a strategy and communications professional (with a strong background in Harvard Law School mediation/negotiation and US public policy) I can vouch for the effectiveness of a united voice that speaks to larger interests oriented towards US economic gains. These kinds of narrow sub-optimal "causes" only make the USCIS and the larger establishment care less about legal employment based immigration.

    Absent in this dialog from this 'erudite PhD' is analyses of root causes of underlying problems. For one, there is the absolutely crystal clear problem with country based quotas for employment based immigration in a country where the primary act, i.e., employment itself cannot be discriminated based on national origin. And so on and so forth.

    Instead of taking cause with such short sighted and self-centered acts, why not apply your collective 'high skills' towards highlighting the POSITIVE CONTRIBUTIONS of legal immigrants and pushing for a better overall process?

    Instead of collecting money to slit the wrists of those around you, why not join hands and petition the lawmakers for better, more transparent processing estimates?

    Instead of trying to make a futile argument that EB1 > EB2 > EB3, why not attempt to have a real public policy dialog that reframes larger interests?

    Further more, dont forget that when the USCIS needs to respond to such frivolous lawsuits, it costs US taxpayer dollars... which further alienates the USCIS and Citizens from the cause of legal immigration.

    No wonder then we find an increase in backlash against non-white immigrants that seek a higher sense of entitlement... seriously... I can bet just as I did with that SunnySurya joker a while ago, put your EB2 petition up online and let us see if there really is no US Citizen available to do the job.

    What makes it fair for a foreigner like you to come to this country and claim that there there is NO ONE to do the job based on which you seek to immigrate?

    If you are really serious about US national interest and the larger question of fairness, it is only fair that you post the EB2 job and we confirm that there is no US person ready and able to take that job. And dont try those advertising tricks, I will hire a lawyer to smoke out your games.

    BTW, I will be looking out for this lawsuit. I will get the details from you directly without you even knowing about it. Heck, I will even contribute to your "cause" so that you give me the details. Then, I will file a separate petition to have your specific EB case investigated for the merits your lawyer posed. Ready for that game?

    Bottomline, I blame poor parenting for creating such characters in society that cause a drain on the moral fabric of humanity.

    Hi folks,

    I'm a desperate house spouse(H4) and now not only I can't work but I can't drive either because the current visa expires on May 10 and the new extension is not here yet. The folks at DMV didn't wanna give an extension for the DL unless I bring a new I 94. Now the poor H1 has to do 2 jobs

    1. work his but off at work to get GC
    2. drive the kids up and down, do the shopping, etc etc because the desperate h4 can't move a finger.

    Anyone in the same barrel?

    seriously , I have seen a couple of people who day dream unrealistic thing and for some time
    thinks thats true. This normally happens, when you normally facing a lot of negative things then your mind things of all the good things,( in your shit load of money on stocks and investments). This actually helps keeping one out of depression in the illusional state. but unfortunately fact is fact.
    As far as I know, I am pretty aggressive in investment and I am getting @15% right now.. which too in a very unconventional ways.. by investing in forex and start ups with a risk of loosing nearly 80% of the investment in a day. when you 100K-200K and get returns like 100k.. dude that 100%-50% investment.. please let me know where can I do that.

    I promise I gonna leave everything and go back with my money make investment in that and live the rest sipping feni by goa beach.

    I think all our folks here and myself have the same question too. My PD is 10/2003 and RD July 2nd. p_kumar, I can assure nobody can answer this question, not even USCIS. I am sure this site would have not existed if there was an answer. Sorry for beating round the bush, I am sure you would have known the answer by now.

    For all those who are upset with the House hearing, please take it easy. Please do not expect the hearing to discuss the details of each and every GC applicant's case. The objective of the hearing was to bring the folks involved in visa bulletins and GC processing, and make them all publically say and agree that Lofgren-Sensenbrenner bill will not flood the country with new people on the borders but at the same time since the federal agencies did not do their job properly, so it would make sense to recapture the visa numbers, and that's it.

    I think that this objective was achieved pretty handsomely without much opposition. So everybody was on the same page, other than Ranking member King, whose job in such meetings is to oppose whatever the committee chair is proposing. Rep. King did not have much to say as Rep. Sensenbrenner has co-sponsored the bill. Noticeably, Rep. Gutierrez supported the bill, which means Hispanic Caucus may not oppose it either, hopefully. So it was all good.

    The meeting really saddens me though. That is the extent of anyone's power to get USCIS moving? Just hinting to King that the congress is displeased?

    I mean I'm pretty sure King is gonna just shrug it off. Listen to how deluded the man sounds. He thinks USCIS is doing a great job, what with all that bragging about efficiency. Obviously he doesn't realize he's standing there, in that meeting. because the efficiency he's bragging about is clearly NOT ENOUGH. In fact, it's pretty much shitty.

    To make things worse, those people in there are controlling the fates of thousands of waiting applicants. And they don't even seem to know the difference btw H1 and 485.

    I don't want to just go on feeding this negative train of thought. I just wish something more effective can be done. Isn't there a better solution?

    By the way, let me clarify that I have nothing against 2006 PD who got approved last month...but my frustration is against USCIS system who does not follow FIFO. Sorry if I have hurt someone's feelings.

    This is really frustrating...moving EB2-I cut-off dates to Aug 2006, approving large number of 2006 PD cases and leaving 2003 - 2005 cases aside.

    Huge debt for everyone? This is going to be the biggest problem because in US, we have a foundation for debt based economy (SSN, credit history, Credit score, credit ratings etc.) If you default the payment, you will have an effect and there will be an impact on future credit applications. There is nothing of this sort in India and the politicians will not allow such things to be setup as well. So essentially back to my point. Banks who lend money are at bigger risk of loosing it. There is nothing that they can do to report on consumer's default or fraud for that matter.

    Now per say consumer dump the property or bank attaches it for non payment of loan amount, Bank will be stuck with properties worth 1/4th for those crores that they loaned to people, maintenance will cost them more to prepare it for sale.

    In any account, there is a big problem ahead there.

    No. It is true to some extent that we are paying more taxes.

    Take my case for an example. My kid is not an American citizen. She moved with us when she was a baby and currently under H-4 status. So she could not obtain social security number that is good for "authorized to work". Without the SSN, we were not eligible for certain child tax credit, which was hundreds of dollars. I tried an ITIN but I got a formal response from IRS that the child still needs to have a SSN to be eligible for the credit.

    If you ever filed your tax return yourself and have a kid, you will know what I mean.

    I started off with a one time contribution many months ago, and then signed up for $20 monthly contributions.

    Today, when I saw the action item for the new funding drive and that the recurring contribution request had gone up to $50, I couldn't initially bring my stingy self to changing my contribution from $20 to $50.

    Then I asked myself, If I were offered a green card today, at an additional 'premium' fee (Besides the filing, attorney fees), how much would I be willing to pay? probably, $2, 3, 4, 5, or even upto $10000. That being the case why was I being a miser about spending $50 a month supporting a great organization like IV.

    With that thought, I immediately went ahead and signed up for the $50 a month contribution and cancelled my old $20 subscription on Paypal.

    I am single and don't have a family to support like most of you do, but this $50 a month will go a long way. We have seen IV get results. From what has gone on in the last few months, up until last night, we know that IV is the only organization that really works for our interest. Oh, Shusterman, ILW, Murthy might all be good attorneys but they don't push our interests like IV does.

    With that, I would request all of you to join hands and work with IV in bringing a revolutionary change to the employment immigration system.

    I think there will not much visa numbers unused. If at all, it may be in few hundreds. We are thinking our point of view, even wasting one visa number is ridiculus based on number peoples are waiting. However, the INA states that every year "not more than 140,000 EB visas should be issued".It sets only upper limit not the lower limit. Therefore DOS has be more vigilant in not exceding 140K. By doing so, there may be a few wastage of numbers. If they issue 120K instead of 140K, it is not the violation of law. Insted if they issue 141K it is vialotion of law.

    However, if the wastage is more than few hundreds it is definitly not acceptable.

    I worked for a MNC here in first few yrs at US (from 2000) and they suck up your Tax return , used to give a worthless health insurance and 'sweat shop' ( this probably a worse word than 'chop shop') like allowance for 12-14 hrs of work . If you do NOT accept that or ASK QUESTION your flight tickets back to origin to will be arranged. I know these practices changed to some extent over a period of time but by that time I left them and started doing things on my own ... :) and i'm very happy since then.

    Another thing , I worked for good but medium sized consulting firms with US after leaving those shops ( sweat/chop/body whatever kind u call them) and they do maintain perfect balance - hardly 30-40% is H1B - they pay market salary to the H1B's ,standard health insurance , always got paid if i worked beyond 8-9 hrs ...

    Lot of folks are like me within the community ...

    Not true. Whatever they can outsource, its already gone. There are certain position where the clients demand onsite resource. I am not supporting this bill in anyway, I hate infy as much as I hate this bill. Remember these companies did not leave any stone unturned, milked the client every possible way and expoilted the employees to the maximum extent. In one another post - VLDRao was saying these companies does the tax filing on behalf the emoloyee, get the refund and again claim that tax in india using double taxation aoivdance treaty.
